2. Description of Service
Curby provides residential trash-valet services, including:

• Pulling customers’ trash bins to the curb the day before scheduled pickup

• Returning bins after municipal pickup is completed

Service availability depends on the customer's address being within Curby’s current service area. Curby reserves the right to refuse service outside designated regions.
3. Subscription Plans
Curby offers:

• Monthly subscriptions

• Yearly subscriptions

Subscriptions automatically renew unless cancelled. Pricing, frequency, and features may change with notice via email or website updates.
4. Billing & Payments
Curby accepts payments through:

• Wix Payments

• Square

• PayPal

• Credit/Debit Cards

• Other common payment processors

By subscribing, you authorize Curby and its payment processors to store your payment information and to automatically bill you at each renewal interval until cancelled.
If your payment fails, Curby may suspend or terminate service until the issue is resolved.
5. Refund Policy
All subscription payments are non-refundable, including partial months.
Refunds may be considered only if:

• Service was never initiated at your address, or

• Curby fails to provide service for an extended period due to internal issues

Curby does not offer refunds for:

• Customer-placed incorrect address

• Missed service due to customer not having bins accessible

• Customer cancellations mid-billing cycle

6. Cancellation of Service
Customers may cancel at any time by emailing support or through their account dashboard (if enabled).
Cancellations become effective at the end of the billing cycle.
There are no pro-rated refunds.
Curby may terminate service for:

• Non-payment

• Safety issues

• Customer misconduct

• Repeated failure to make bins accessible

7. User Accounts
Customers may create accounts to manage subscriptions and billing.
You agree to:

• Provide accurate information

• Maintain confidentiality of login credentials

• Accept responsibility for all activity under your account

Curby may delete or suspend accounts for violations of these Terms.
8. Customer Responsibilities
To ensure successful service, customers must:

• Place bins in an accessible location on service days

• Ensure bins are unlocked and free of obstructions

• Inform Curby of changes to municipal pickup schedules

• Secure pets or hazards that may obstruct Curby staff

Failure to meet these responsibilities may result in a missed service, without refund.
9. Service Limitations
Curby is not responsible for:

• Changes in municipal pickup schedules

• Extreme weather preventing service

• Hazardous materials found in or near trash bins

• Theft, damage, or loss of municipal trash bins outside Curby’s control

Curby will make reasonable efforts to complete service as scheduled.
10. Intellectual Property
All content on Curbyco.com, including branding, logos, images, service descriptions, and website design, is the property of Curby LLC.
Users may not copy, reproduce, modify, or distribute any content without written permission.
11. Prohibited Use
You may not use the Website or Service to:

• Engage in unlawful activities

• Attempt to disrupt operations

• Misrepresent identity or address

• Harass Curby staff

Violations may result in immediate termination.
12. Disclaimers
Curby provides services “as-is” and without warranties of any kind.
Curby is not liable for:

• Injury or damage resulting from misuse of trash bins

• Accidents occurring on customer property

• Municipal errors or delays

13. Limitation of Liability
To the fullest extent permitted by Michigan law:

• Curby is not liable for indirect, incidental, or consequential damages

• Curby’s total liability is limited to the amount you paid in the 3 months preceding any claim

You agree to indemnify Curby against claims arising from:

• Your misuse of bins

• Unsafe conditions on your property

• Violations of these Terms
   

14. Governing Law
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict of law principles.
Any disputes will be resolved exclusively in courts located in Michigan.

15. Privacy & Data
Curby follows the privacy practices of third-party processors including Wix Payments, Square, PayPal, and others.
Curby does not store full payment details on its own servers.
